STUDIO RENTAL AGREEMENT
The undersigned (herein referred to as the “Renter”) expressly acknowledges reading, understanding, and agreeing to be bound by the following terms and conditions in connection with the rental of Studio BanglamartBD’ (hereinafter referred to as the “Company”) photography studio.
1. Payment:
All studio reservations made by the renter will be fully paid for in US dollars. No date will be reserved for the renter until this payment has been received and approved.
Payment is nonrefundable unless cancellation is made at least 72 hours prior to the date of the renter’s reservation (Renter will receive a full refund if cancellations occur prior to 72 hours before the reserved date).
Renter will get a full reimbursement if the company must cancel their reservation. Before Renter’s reserved time starts, Renter’s rental must be paid for. The company retains the right, in its sole discretion, to reject reservations.
2. Length of Use:
The length of an hourly rental is 60 minutes. The length of a half-day rental is 4 hours. Rental times for a full day are 8 hours. By the end of the rental period, the studio must be cleaned.
A clean-up fee will be charged in accordance with the most recent Studio BanglamartBD Rate Sheet if the studio is not adequately returned to the condition it was in before the rental term. When the renter is either continuing utilizing or cleaning up the studio space after the agreed-upon end time of the rental period, overtime will be assessed in 15-minute increments. The Studio BanglamartBD Rate Sheet will be used to determine how much overtime will cost.
Please be on time, the renter’s rental period starts at the given starting time and concludes at the designated finishing time.
Don’t ask because there won’t be any exceptions to this rule.
3. Terms of Use:
Use of our studio and our tools is at the risk of the user. By signing below, Renter renounces their right to legal action in the event of an incident, injury, or loss while on our property. Renter pledges to return the studio and surrounding property in the same state as when they were found.
Renters are completely responsible for any legal violations they or other members of their party commit while the shoot is taking place, whether it takes place at our studio or anywhere else. This covers parking fines, any other infractions or citations, and any further legal actions stemming from the execution of the shoot, regardless of when they were taken.
While on our property, the renter agrees to hold Studio BanglamartBD, its owner, agents, representatives, and contractors acting on its behalf harmless from any loss, accident, or injury to the renter or anybody they bring with them.
The renter acknowledges that while on our property, they are completely responsible for their behavior and the welfare of any guests they bring. The safety and welfare of any models the renter engages are exclusively their responsibility.
Renter is aware that the Company reserves the right to halt the shoot and order Renter and Renter’s party to leave right away if it notices any risky, pornographic, or careless practices or activities are taking place; however, the Company assumes NO RESPONSIBILITY to take any action in such circumstances.
Renter agrees to defend, indemnify, and keep Studio BanglamartBD, its agents, representatives, and anyone else acting on behalf of Company, free and harmless from any claim or demand, legal or otherwise, arising out of Renter’s conduct.
Renters are completely responsible for making sure all models used throughout their rental time are of legal age to participate in the planned activities. Although the company has no need to ascertain or confirm the participants’ ages in the renter’s activities, it does reserve the right to put a stop to those activities if it becomes aware that ongoing legal age restrictions exist.
Renter acknowledges that while renting out the studio, a company representative must be present at all times.
4. Equipment:
While the company promises to deliver equipment that is in excellent working condition, it makes no specific promises about its functioning or suitability for the renter’s needs. Power outages, bad weather, or other uncontrollable events that have an impact on the shoot are not the responsibility of the company. In these circumstances, the Company will reimburse the Renter for a portion of their payment.
5. Arbitration:
The parties agree to submit any conflict or claim arising under this Agreement to binding arbitration, according to the commercial arbitration rules of the American Arbitration Association, if they are unable to resolve it themselves.
In Saint Louis County, Missouri, the arbitration will take place. The parties also agree that any such dispute or claim shall be brought before one arbitrator chosen from the American Arbitration Association’s panels of arbitrators, that they will abide by the terms of this agreement and the Rules, that they will obey any award made by the arbitrator, and that the arbitrator’s decision may be enforceable in court.
Regardless of what has been stated, if the disagreement is worth less than $200, either party may decline to arbitrate.
6. Miscellany:
The complete understanding and agreement between the Client and the Company is incorporated into this Agreement. Any changes to this Agreement must be made in writing and include the signatures of both parties. Any waiver of a breach or default under this Agreement is not intended to apply to subsequent breaches or defaults of the same provision or any other provision of this Agreement.
This Agreement will be governed by Missourian law. The parties acknowledge that they have read the entirety of this Agreement, concur with all of its provisions, and have received a fully executed copy of the Agreement. Each individual who signs below on behalf of the Client is solely responsible for seeing that the agreed-upon terms of payment are followed.
